ELIGIBILITY:SHARE YOUR SPORTING PRESENTED BY CAPITOL FEDERAL® Promotion (the “Promotion”) is open to legal residents who live within a seventy-five (75) mile radius from Kansas City, Missouri (the “Territory”) who are of legal age of majority in the jurisdiction in which they reside (and at least 18 years old) at the time of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Capitol Federal, OnGoal, LLC a/k/a Sporting Kansas City (the “Sponsor”), Major League Soccer, L.L.C. (“MLS”), and Soccer United Marketing, L.L.C. (“SUM,” and collectively with Sponsor and MLS, the “MLS Entities”) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Promotion are not eligible to participate or win a prize. The Promotion is subject to all applicable federal, state and local laws, rules and regulations. Void seventy-five (75) miles outside Kansas City, Missouri and where prohibited or restricted by law, rule or regulation.
PURPOSE OF PROMOTION: Capitol Federal and Sporting Kansas City want to highlight the passion of Sporting Kansas City fans by showcasing favorite moments and highlights from Sporting Kansas City matches, watch parties, or family trips wearing their Sporting Kansas City gear. Photo, video, or social feature reply, submissions may include family, friends or individuals. A total of four (4) winning photos will be selected by Sponsor from all eligible entries based on originality, creativity and incorporation of the Sporting Kansas City brand within the video or photo submission, as determined in Sponsor’s sole and absolute discretion.
HOW TO ENTER: A computer or mobile device with internet access is required to participate in this Promotion. Promotion will begin at 12:01 a.m. Central Standard Time (“CST”) on March 17, 2022 and ends at 11:59 p.m. CST on October 9, 2022 (“Promotion Period”). The methods of entry will include Twitter, Instagram and email. No other methods of entry will be accepted. Multiple entries will be accepted.
- Twitter: To enter the Promotion using Twitter, you must be a registered user of Twitter.If you are not a registered user of Twitter, sign up for a Twitter account at www.twitter.com or through the Twitter application by downloading it onto your iPhone or Android (available via Apple App Store and Google Play, respectively). To be eligible for a prize, you must follow the official Sporting Kansas City Twitter account (www.twitter.com/sportingkc). To enter via Twitter, upload one (1) video or one (1) image sharing yourself in Sporting KC gear at a Sporting Kansas City game and/or event (official Sporting Kansas City games, watch parties, tailgates, etc.) and include the hashtag, #capfedskc, in your post. Video content is encouraged but photos will be accepted and must be in digital format. Twitter’s clock will be the official timekeeper for the Promotion. If you make or receive tweets on your mobile phone, standard text messaging rates will apply. In order to participate in the Promotion without receiving tweets on your mobile phone, be sure to deactivate your mobile phone from your Twitter account. Multiple entries per person or Twitter account will be accepted.
- Instagram: To enter the Promotion using Instagram, you must be a registered user of Instagram. If you are not a registered user of Instagram, you may sign up for an Instagram account at www.instagram.com or through the Instagram application by downloading it onto your iPhone or Android (available via Apple App Store and Google Play, respectively). To be eligible to win a prize, you must follow the official Sporting Kansas City Instagram account (www.instagram.com/sportingkc). To enter via Instagram, upload one (1) video or one (1) image sharing yourself in Sporting KC gear during a Sporting Kansas City game and/or event (official Sporting Kansas City games, watch parties, or tailgates, etc.) and include the hashtag, #capfedskc, in your post. Video content is encouraged but photos will be accepted but must be in digital format. Instagram’s clock will be the official timekeeper for the Promotion. If you choose to enter via Instagram using your mobile phone, standard data fees may apply. See your wireless provider for pricing plan details. Multiple entries per person or Instagram account will be accepted.
- Email: By sending an email during the Entry Period to [corppartner@sportingkc.com] with the subject line “Share Your Sporting Contest” attaching one (1) video or one (1) image sharing yourself in Sporting KC gear during a Sporting Kansas City game and/or event (official Sporting Kansas City games, watch parties, or tailgates, etc.). Video content is encouraged but photos will be accepted but must be in digital format.
All video, replies, and/or photos submitted via email, Twitter or Instagram will become the property of the Sponsor and will not be acknowledged or returned. By entering the Promotion, you represent and agree that you have acquired, prior to submission of the entry, permissions, including, without limitation, permission to use names and likenesses, from individuals included in any submitted photo or video for entry to the Promotion subject to the terms of these Official Rules. If any identifiable person appearing in the entry is under the age of majority in his/her state of residence, the parent or legal guardian is required to provide permission. Sponsor reserves the right to require proof of these permissions in a form acceptable to Sponsor from any entrant at any time. However, only the primary entrant is eligible to win a prize. The entry must be original, truthful, unpublished, and created solely by the submitting entrant. In case of a dispute over the identity of an entrant who submitted a potentially winning entry, Sponsor reserves the right to deem that the entry was submitted by the registered accountholder of the email, Twitter or Instagram account, as applicable, at the time of entry.
Entries cannot defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. There must not be any proprietary background containing artwork or recognizable commercial logos, or any inappropriate or offensive materials in the entry. Entries that are incomplete, illegible, garbled, late, damaged, or corrupted are void and will not be accepted. Entries that are not in keeping with Sponsor’s image or that are otherwise not in compliance with these Official Rules, may be disqualified by Sponsor in its sole discretion. By entering, you agree to assign all right, title, and interest, including copyright rights, in the photos/videos and the entry to Sponsor and grant permission for Sponsor and the other MLS Entities and their respective designees the right to use the photos/videos and any other portion of the entry including, without limitation in promotions and advertisements for Sponsor, worldwide in perpetuity, without notice or permission and without further compensation, except where prohibited by law.
All information submitted by entrants is subject to, and will be treated in a manner consistent with MLSsoccer.com’ Terms of Service accessible at http://www.mlssoccer.com/terms-of-service, and Privacy Policy accessible at http://www.mlssoccer.com/privacy-policy (both of which are incorporated herein by reference).
This Promotion is in no way sponsored, endorsed or administered by, or associated with Twitter or Instagram. Any questions, comments or complaints regarding the Promotion shall be directed to Sponsor and not to Twitter or Instagram.
SELECTION DEADLINES: There will be no less than four (4) winners (each, a “Winner”) selected by Sponsor throughout the 2022 MLS season, one (1) Winner to be selected on a quarterly basis at Sponsor discretion from all eligible entries received by the applicable selection deadline.
QUARTERLY SELECTIONS: The Winner(s) will be selected as indicated above from among all eligible entries received by the applicable selection deadline by the Sponsor. The decisions of Sponsor are final and binding on all matters relating to the Promotion. Odds of winning depend on the total number of eligible entries received. Limit one (1) Prize per person, family and household.
PRIZES: Each Winner will receive one (1) of the following prizes:
- Prize 1: four (4) match tickets, (4) customized team replica jerseys, one (1) team autographed item, transportation (from a designated location as determined by Sponsor) to and from Children’s Mercy Park, Sporting KC VIP Experience including; Inclusive food and beverage with access in the Shield Club, opportunity to watch warm ups on the pitch, and opportunity for a post-match photo on the pitch (the “Prize”). Approximate Retail Value (“ARV”) of Prize 1 = $1050.00.
- Prize 2: One (1) VIP Happy Hour for six (6) people at No Other Pub, to include a meet and greet with two (2) Sporting KC players; one (1) reserved table and bowling lane; food and beverage credit in the amount of $200; six (6) customized Club replica jerseys; and one (1) team autographed merchandise item (the “Prize). Approximate Retail Value (“ARV”) of Prize 2 = $750.00.
- Prize 3: One (1) VIP Sporting KC training visit and tour of Compass Minerals National Performance Center for six (6) people, to include a meet & greet with one (1) Sporting KC player; six (6) customized Club replica jerseys; one (1) team autographed merchandise item, and round trip for six (6) from a designated location to be determined by Licensor to Compass Minerals National Performance Center (the “Prize). Approximate Retail Value (“ARV”) of Prize 3 = $1500.00.
- Prize 4: Four (4) tickets to Pitch Black; to include VIP reception; four (4) customized Club replica jerseys; one (1) team autographed merchandise item and round trip transportation for four (4) from a designated location to be determined by Licensor to Children’s Mercy Park or location of Pitch Black (the “Prize”). Approximate Retail Value (“ARV”) of Prize 4 = $2100.00.
Each of the above prize packages is considered a “Prize”. Sponsor shall determine which Prize package to award to each Winner in its sole discretion and all awards are final. Each Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging accommodations, any other transportation costs, luggage fees, meals, gratuities, and other expenses incurred by accepting the Prize are the sole responsibility of (each) Winner. All Prize details are at Sponsor’s sole discretion. Winner’s guests must be of legal age of majority in their jurisdictions of residence.\[MB1\]
Each Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute a Prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion. MLS game, event, and exhibition dates and times are determined in the sole discretion of MLS, the applicable MLS team and CONCACAF, as applicable, and may be subject to change. Seat locations will be determined by Sponsor. The terms and conditions of the tickets awarded as Prizes will govern in the event a MLS game, event or exhibition, as defined by MLS, is not played due to weather, an act of God, an act of terrorism, civil disturbance, work stoppage or any other reason. Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the Prize. Sponsor and the other MLS Entities reserve the right to remove or deny entry to Winner(s) and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any MLS game, event or exhibition. Released Parties (as defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster that may cause the cancellation or postponement of any MLS game, event or exhibition.
NOTIFICATION: Each potential Winner will be notified via email, direct message on Twitter, or as an @reply on Instagram, depending on the method of entry. In the event that any potential Winner does not respond to any such notification within three (3) days of date of issuance, a disqualification will result, Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be chosen from among all remaining eligible entries. Each potential Winner may be required to submit his/her valid social security number (if applicable) and/or other identification to Sponsor and will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity, within five (5) days of date of issuance. A disqualification will result, Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be randomly selected from among all remaining eligible entries if all required documents are not properly executed and returned within the specified period of time. Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and Prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential Winner to be selected from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Promotion and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor, the other MLS Entities, Twitter, Instagram and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Promotion, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. Each Winner, by acceptance of Prize, grants to Sponsor, the other MLS Entities and each of their respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, for any purpose, unless prohibited by law.
GENERALCONDITIONS: Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, delayed, undelivered, inaccurate, or garbled entries. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prizes or in any Promotion-related materials, or the cancellation or postponement of any MLS game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer, mobile phone or tablet related to or resulting from participating in this Promotion or downloading materials from or use of the website.
In the event that the Promotion is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Promotion, or to disqualify entrants residing in the affected geographic areas. In such event, Released Parties shall have no liability to any entrants who are disqualified due to such an action.
Persons who tamper with or abuse any aspect of the Promotion or website or attempt to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Promotion is unlawful and subject to legal action by the Sponsor, the MLS Entities and/or their respective agents. Sponsor and the MLS Entities shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Promotion, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the state of Kansas without giving effect to choice of law or conflicted law principles (whether of the state of Kansas, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Kansas. Sponsor’s failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision.
The Sponsor and the other MLS Entities, as applicable, reserve the right, in their sole discretion, to cancel or suspend the Promotion for any reason, including should virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Promotion. In the event of cancellation, Sponsor may elect to identify the Winners and award the Prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND THE MLS ENTITIES WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSOR AND THE MLS ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity or eligibility of a Winner, the winning entry will be declared made by the “Authorized Account Holder” of the email, Twitter or Instagram account at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the email provider, Twitter or Instagram has assigned the account. Sponsor reserves the right to modify these Official Rules for clarification purposes at any time.
